My only point is, this 1% of active members can politely direct others to state chapters , notwithstanding the frustrating attitude of some of the "Highly skilled"- arm chair critics.

My two friends are leaving.
They are completing six years. Their labour is approved. but I 140 is not approved.
They applied for their labour in sixth year.
Due to retrogression they are unable to apply for I 485 and EAD. They are working as DB2 DBA's.
They choose last option to leave the USA.

I was told that people on H4 are not eligible for SSN, and if I want she (the person on counter in ssa office) can issue me a denial letter for that. It sounded useless to me that time, so I didn't bother to get that letter.
This idea sounds good to me, I'll go to SSA office again and try to apply. Offcourse they will say that they can't accept application. So I'll get a denial letter and I can appeal against that.
They cannot refuse to accept your application. Fill in the forms and send them in. They can deny your application and then you can appeal. If they refuse to accept the application, you have two options. You can contact your congressman and complain. You can file a discrimination complaint with the SSA ombudsman. Here is the discrimination form.

Finally, if you believe you have been denied your rights because you are an immigrant, you can contact your local ACLU and ask them to represent your case. As a last resort, you can file a lawsuit at the federal district court. The filing fee for this is $350. However, I hope we are all doing this to exercise our rights rather than for the money. In my opinion, with this global economy - if the spouse is well educated and can work, there should be an opportunity for that person to work (atleast few hours per day).
Sitting at home and taking care of kids for long, can drive a capable/educated individual to psychological issues, which can overall have an impact on family as well as the mental wellbeing of the breadwinner.
What happened to all those Equal rights for women/dependents etc etc groups in the US? Ofcourse I am not saying that all H4 people are women (the majority is women)

my company might use this one and i have no say on this. just wonder whether the new york office is good in regard to GC process.
FRAGOMEN SUCKS TOTALLY - but unfortunately I got no choice - my employer uses these morons for immigration services. My reasoning is based on my experiences below:
1. I have been mailing Fragomen for 3 MONTHS (YES THREE FULL MONTHS) to initiate my H1 extn 6 months prior to my visa expiry cause I had a need to travel outside the US in a short notice and I did not want to be stuck because of me not having my visa extn papers in time. Despite 5 e-mails and 5 voice mails - there was no response from FRAGOMEN. Escalated this with my company and we had a conference call to discuss this issue with Fragomen. Guess what FRAGOMEN's Client Service Manager had to say when I asked her about they not answering my e-mails and voice mails for 3 months - "I CANNOT ANSWER THIS QUESTION SINCE EVERYCASE IS DEALT DIFFERENTLY AND WE DECIDED TO INITIATE UR H1 EXTN 3 MONTH PRIOR TO UR VISA EXPIRY." WTF!!! Who the hell are they to decide on my professional/personal travel needs? I really wish I had their job - do nothing at all and when questioned say "I cannot answer that question".
2. To make sure FRAGOMEN do not mess up my 485 as well, I asked them in the same call the time they would take to process and file my 485. The client service manager promised me that they would file my AOS in 4 business days from the day they receive all the documents from me. I made sure I sent all the documents including Medical Exam results in less than 2 days from the day we had this call. Guess how long they took to file my case - 3 full weeks - 15 business days!!!!
For the kind of money they charge, the service is totally bad. FRA-DON'T-GO-MEN might be a better name these guys.

Even according to my lawyer there are not much cases in 2004 /2005 EB3 I...
Guess many have chosen EB2 as they were eligible by that time .I dont understand why EB3 I is being projected so negatively.
Many have already transferred EB3 to EB2.
2001/2002 may be there are still duplicate open applications which USCIS have to sort out .
Lets hope for the best...But seeing Bharat Premi responses...builds hope.

Yes, I believe you are correct. If you've used the old fee structure in July 2007, you need to pay for EAD/AP renewal each time.

Eb3 v/s Eb2 is a nonsensical nonproductive meaningless argument. If you actively participate in speaking with the lawmakers, you would know the bogus nature of this squabble. Each one of us has a choice. We can continue with this pissing contest or we could do something to fix the backlogs. We all understand the frustration and anxiety due to the long delays. It is easy to be drawn in meaningless eb2 v/s eb3 quarrel in the virtual world when one is not privy to how things work in the real world.
If you feel compelled to engage in infra and trivia, please utilize your energy for your benefit by understanding the larger debate so that each one of us can employ our energy to fix our issues. Please use your energy in a positive manner. There is no point of this discussion. It is easy to write/post arguments just to support your own application/position in line. Anybody can do that. But such narrow minded approach will not help even a single soul on this planet, including yours. For those of you who want to continue with this bickering, you can do so at the expense of your own time. And when you engage in such arguments, please remember that whatever you all write or post about this nonsensical back-and-forth is not helping you or your family. But if you are sincere and care for this issue, if you truly care for your issue, then please consider participating actively to meet with the lawmakers to make our voices heard.
Members who actively engage in the advocacy effort know when we are saying. For example – talk to nearly 125 IV members who lead the lobby day in DC during the past week. They will tell you the bogus nature of this Eb2 v/s Eb2. Stop wasting your energy arguing thing which have no meaning. I thought IRS will allow you to withdraw your 401(K) with a 10% fine + all applicable taxes. Not sure how that will benefit someone who is forced to withdraw becuase he has to return to India.
You go back to India and withdraw one year later when you have 0 US income. Anything below 15K income is not taxable. Your 401 (K) withdrawal is added to your income for taxes

Can you give us some more details about the call to get receipt number?
One of my friend called but they said they can only give I-140 Receipt no to employer.
I called USCIS today and they asked my name and date of birth and they gave me my Receipt Number for I-140.
My I-140 was recieved on July 16th and they generated a receipt notice and have sent me...I shud probably recieve it by this week.

I think a change of leadership of IV is critical if we have to get anywhere. IV has not been able to achieve a single thing in all of its existence. Not a single thing, nada, zitto, zapata. Not disclosing the issues they are working on, not disclosing how the funds are distributed, not disclosing the lobbyist they are using. Who in the world calls that leadership!

Canada does not have 50 universities, in TOTAL. So your choice is limited to
(1) Queens University in Kingston, Ont.
(2) University of Toronto
(3) UBC

Besides many universities in Toronto area (McMaster, Toronto, Waterloo, York, Ryerson) other Provinces such as Alberta, Saskatchwan, Manitoba, Quebec, New Brunswick, New Foundland, etc. all have good universities. If you are a PR, tuition is very low compared to the US. If you are outstanding in your field, you can hope for a grant too.

Hi all,
First I thank IV core team for making the D.C rally a big success.
Here are few of my thouts.
1)To get more chinese and other foreign nationals involved in our team we better to put active chinese and other nationals in IV core team (Its just my idea and if you think its not a good one please ignore it.)
2) Yes we better do a second rally but at thesame time we better to educate them first by giving adevrtisements and things like that.
