USCIS has once again updated its announcement regarding the number of H-1B petitions received and counted towards the H-1B cap. As of May 4, USCIS has received approximately 45,000 H-1B petitions counting toward the Congressionally-mandated 65,000 cap. As such, USCIS continues to accept petitions subject to the general cap. Additionally, that USCIS has received approximately 20,000 petitions for aliens with advanced degrees remains unchanged. As such, the Service continues to accept advanced degree petitions as experience dictates that not all such petitions are approvable. I also received RFE. It was related to TB chest X-ray. In '07 doctor said, it is not requited but USCIS feels other way.

Dear Sir/Madam,
My h1b status (and I94) is valid till 20 Feb 2010. Few days back I have applied for my h1b extention on PP after completing 4 years 6 months. My I140 got rejected couple of months back and I appealed on it, It is on pending now. Basically i am looking for an options if my h1b extention gets denied , can i appeal for h1b extention and get h1b extention based my I140 appeal. Are there any other ways to continue to work in usa? or Do I need to leave usa immediatly? if yes with in how many days?
Greatly appreciated your help regarding this. Please kindly help me regarding this.

In addition, approximately 20,000 U.S. Master's or higher petitions (i.e. advanced degree petitions) have been received. Any advanced degree petitions received from here on out will count toward the regular cap of 65,000. The USCIS is still accepting petitions at this time, but it is advised that any H-1B petitions be filed as soon as possible as the USCIS could announce that the cap is closed at any time.

I am planning to visit India for a10 days in October. I have a valid h1b status till 2010 which I thinking of getting stamped at new delhi. But it seems the PIMS verification delay is making people wait for weeks and months. I have an AP which I can use to enter as an alternative. But I wanted to know if anyone had experience in stamping at the delhi consulate? Do they keep the passport if it is send for PIMS verification? In that case I'll drop the idea of getting it stamped and use my AP (though I want to avoid doing that snce I want to maintain my h1b status).

I've had my I-140, I-485 pending since August 2007 in Nebraska and i just started getting worried recently when i found out that the job title in the I-140 does not match the job name in my labor cert.
My labor cert took 4 years to be approved and in the meantime my job changed. It is still in the same field/department, in the same company, but it just evolved but still requires the same skills as the labor cert.
I was originally on H-1B and now i work with my EAD. My H1B was amended when my job changed but not the labor cert since we were well into the process when all this happened.
This is really the only concern that i have regarding the approval of my I-140 and I-485. Do any of you know if the job name difference would be a problem for the I-140 to be approved? At the least i hope they would send me an RFE and not deny it right away.

I had FP done way back in October 07..but there is no status change LUD on I-485..what to do??.:confused:..Do I take an appointment to talk to an officer or simply call USCIS ..

I've my current AP and EAD valid till july 2010. I would like to apply for renewal of AP and EAD.
Can I travel while my AP and EAD are in process using my existing AP and EAD(before july).

The absence of I485 receipt may be an issue, because they would put a stamp on that paper after taking your (I485) FP. They would do the same on your EAD FP notice letter.
