I applied for green card via national interest waiver category, and I decided to obtain green card through consular processing. To be eligible to get the immigrant visa in my home country, I showed consulate an offer letter from a U.S. company.
My question is , do I really have to work on that job after I enter U.S. ? Because I am not very interested in that position. And I am thinking about studying for an MBA, instead of working.
I was given a temporary green card when I entered the custom. It usually takes 2 month to get the official green card. But if I reject that offer , would my green card be revoked ?

It seems USCIS has set a quota of �X� number of 485 applications till SEP �07.Once that quota reaches, dates will retrogress.
After that 485�s will be processed by PD and not by RD.

that is required to be maintained by the employer for all employees (even US Citizens)
Yes on EAD you can/have to fill that

I am kind of confused about my situation. Will try to detail it; any help is greatly appreciated!
I was working with company A until July 2009. They had filed my F1 to H1 COS Application in April 2009, which got approved. I have the receipt for that. I lost my job in July 2009 and found another one. My new employer, Company B, filed a NEW COS Application (which they said is subject to the H-1B cap, which is confusing cuz they could have used the receipt number from my previous approval I think)
Anyway, I contacted the attorney from Company B and they said I should call company A and have them cancel my H-1 COS Application. I called the attorney from Company A and she said she would cancel the H-1 Application. She also mentioned about ME having to send a letter to USCIS. Why do I have to send this letter? Is it so that I can go back to my F1 status? What should it say?? Please help!

I guess you can, provided you gain the specialized knowledge during that duration (6 - 7 months) which you currently lack to get the approval.

My lawyer filed my I-485 and it reached NSC on Aug 9, 2007.
I have not recd. any I-485 receipt notice or number yet.
Can i still track my I-485 progress using my I-140 receipt number on
the USCIS website somehow ?

On I140 form, notice type has information about INS section.
The INS section explain that your GC is under EB2 category or EB3 category.
INS section details
INA Section 203(b) (2) is EB-2
INA Section 203(b) (3) is EB-3

USCIS has released figures from the first week of the H-1B season and filings for the 65,000 H-1B "regular" cap slots for the fiscal year that begins in October were just 13,500. That is less than one third of the 42,000+ received during the same period last year and only about one-tenth of the number filed two years ago. Only 5,600 masters cap applications were filed against the 20,000 cap in that category.

I was just pondering on why Madame Pelosi has not woken up from her slumber and acted on the letters that she is recieving . I can count 10 letters from my relatively short memory . Wonder when she will ACT and stop recieving and filing letters . JUST 54 days are left in 2007 . :eek:

Hello,
My firm is about to start greencard processcing for me and this is the first time that they are undergoing this process. They are searching for letter templates which decribes the employee eligibility and responsibilies in the firm and why they want to recommend greencard for this perticular employee. If anybody can upload such kind of templates/documents, that would be of greater help.

Just need some suggestion:
I may be on the chopping block next week..
currently am on my 8th year H1, expires march 2010..so less than a year to restart..and be back in the line. (spouse on H1)
My 140 is pending...
so if i lose my job.. can i go to H4.. even though i have stayed here for more than 6 years..
and in case if i get job ...can i get back on H1 and restart GC?
i am thinking.. i have come to the end of all options.. and the only course available for me is back to desh..any inputs..will be appretiated..

I am currently working on H1B visa. I also had an EAD which expired 2 months back & I applied for renewal of the EAD last month. I am at the risk of being laid off by my current employer & they will withdraw my H1B if that happens. Here are my queries-
(1) If I lose my H1 status & my EAD approval is still pending, what do I need to do? If I am unable to find a new H1B sponsor, will I have to leave US immediately?
(2) Will my H1 cancellation have any effect on my EAD & AP renewal petition?
(3) Can I return to US & work after my AP & EAD are approved?
(4) If my EAD approval happens before my H1B visa is revoked, can I legally stay & work in US on the basis of ONLY the EAD?

I just got H1B. My wife is currently on her F-1/OPT. Can anyone guide me where I can find required documents to apply for H4 for my wife? Do you think I can do it myself or it needs a lawyer?
