My friend, "USA point of view is multinational executives can potentially create jobs", but the reality is the other way round. They are here to to make the transition happen from Onshore to Offshore. I have complete knowledge on how this EB1 thing works , as I was one of them once upon a time before taking up my current job.
I'll stop and leave it here....
The original intention of EB1 (all three categories) was to have exceptional contributors like scientists/researchers/managers, etch to have highest priority in getting GC. Now over time people have found out loop holes as the language of the requirement criteria has a lot of ambiguity. I guess intention of the current memo is to over scrutinize the claims in these applications to ensure that only genuine candidates qualify. Again this is not fool proof and people will find a roundabout. The desparate condition of the EB green card waiting list is causing people to try and move to the higher preferance category either by using correct means or by using loopholes.

gctest, personally I don't see any issue with eb3 to eb2 porting, look at the porting opportunity from eb3 applicant's point of view, these applicants are waiting since 2001 for GCs but EB2 applicant with PDs 2005 are getting GCs, eb3 to eb2 porting is a way for them to jump ahead of 2006 eb2 filers and get their GCs, I don't see anything wrong with it, sure it causes 2003/04 eb2 filers (very few I guess) to wait a little longer but every law has a loophole and we just have to live with it,
How many eb2 filers are really qualified for eb2 labors? I see lot of consulting firms abusing eb2 labors and lot of people who are playing the game fair are left behind, I feel porting labor is a way to level the playing field, also people who filed eb3 labors in 2001, 2002 are qualified for 2005 eb2 labor anyway, just think these applicants file eb2 labor in 2005, as you said if they are not eligible they will be denied to use the opportunity and its OK if you wait a little longer

Thanks for the information. Bills come and go every year, hard to count how many we have seen go up in the air in the last 3 years.
We are talking about HR 5882,5921 and 6039. Very few people are working very hard to take all of us a step ahead with the GC process and we have lots of hope and we also have direction. Please check with your state chapter lead for latest updates.

USCIS has proven again that they cannot calculate or count. Don't you think they should be presented with this calculator to help them calculate.

Administration may not want to add that right now. I had poll long back to find out many of us are interested into it . Only few replied , with limited resources we cannot achieve any thing.
IV core had same and similar job , AC21 on agenda for this year's agenda. FOIA was small side project at that time.
Now coming to main point ... We see so many news that CIR is coming in early 2010. Administration may not want to add pre registration at that time when CIR passes and all dates become C for 2- 3 years. Then this pre registration will not help as long as you have labor approved. Whole admin fix is based on rule making process and that takes near to 6 months. Also new forms and new memo to all CIS dis offices. Way too for CIS my friend. They can be only on track with new process after year.
If we could have done that last year then it might be helpful. Even I recently did some research and found that Pre registration process that those lawyers talks to attract us is for H1B. CIS wants to implement for H1B and then try out for other non immi worker category and then for Green card applicants. I bet you we will get GC by then.

my PD were current in 2005.
One thing is confirmed:
When PD are "current" they approve cases based on RD.
My guess is in Oct or Nov 2007 PD would retrogress to jan/may-2004 for EB3 India. So hang in there guys!!..They will approve a lot of cases with older RD by Sept 30. They are hell bent on not wasting any visa numbers henceforth.
