My suggestion would be.
If your PD is After Jan 2004, you better get started and look for a position in EB2. If your PD is before Jan 2004, you wait and watch until end of this year and then make a informed decision. But in the long run , it makes lot of sense to be in EB2 if your job requirement is eligible for it.
Also take a look at the trend of the PERM processing. as per 2007 stats 40% of the cases got struck in audit process.

I applied end of March online at TSC. If they are approving within a month I would have got approval long back and not today. It is not coincidental they are approving so that they can give 1 year renewal.

if my previous company revoke my visa after the new copmany filed for the transfer will this be a reason for ins to deny my h1b transfer?
Once you get a receipt for your H1 transfer application you can start working for the new employer. From that point onwards your H1 application is linked to your new employer and no longer dependent on your old employer. I would suggest follow up with USCIS regarding your case.

anyone else having problem filing EAD & AP in time with fragomen, pls share.
Is fragomen filing EAD & AP on time?
I have been following up with them to file my EAD renewal since 10 days and today I received a response that they are busy with audit and will do as soon as they can, I don't want my ead application to be delayed, its already more than a week I was eligible to file EAD renewal.
Anyone else having problem or I am the only one?

Hey guys,
if you look at Page 8 of I-131, USCIS says that if you filed I-485 after July 30,2007, then you don't need to pay the $305 fees.
Assuming one filed I-485 on 1st August 2007, will he/she be exempted from this fees? Anyone had been in such situation?
You do not have to pay fees, if you had filed your I-485 with the new fees. If you 485 was filed based on July 07 VB or earlier, then you still have to pay fees. The July fiasco as we all know, there are a extension till Aug 17 to file I-485 with the old fees, these applicants still have to pay fees for AP renewal even if filed between Aug 1 through 17

Buddy...take it easy on yourself. I can feel your pain, waiting for almost 10 yrs now...still no sign that this wait will end anytime soon.
But rather than blaming the system and whining, i keep myself content with the fact that no one is forcing me to stay in this country- it's my own choice that i want to continue taking their bullsh*t.

You are right that it is a long wait...for me ten years is almost coming, but no relief yet. I hate to get these documents renewed every year. It is a vicious cycle whole year round to update one or the other document in different points of time. It is becoming a nightmare when we could do something useful instead.
And yes you are very right that I am responsible for my own choice, but after spending 10 years of my prime life and youth I think there are vey few options otherwise. More importantly when you have kids grown up and more assimilated here. You don't want to force your will on them. I hope you understand what I mean.
BTW, I am surprised that people have given me red dots from behind. Talk to me directly if you think I am wrong.

I did not go to DC because i did not want to get the green card this way.I grew upwatching aunts,uncles coming from USA bearing gifts.I grew up watching cousins go for USA for higher studies.It used to be so special. You stand a better chance of getting it through your kids if they are citizens than getting it through EB3. There are a few options to get green card faster. Canada is not one of them.
1. Get a Ph.D, get a job in a univ and apply in EB-1.
2. Get a MBA and get a management job and apply in EB-1.
3. Become a religious worker in some temple and apply in the religious worker category.
Fun apart, if you feel comfortable that you can find a job of your liking, and you believe your background will qualify you for a PR, consider Canada. It is a good place to live. You never miss home there. I am a Cdn citizen and have lived there for many years. Most likley I'll return back to Canada when I decide to retire. I know at least one person, who after living in the US for 11 yrs and unsuccessful in getting a GC, chose to make Canada his home, hoping to be there just for 3 yrs (needed to be a citizen), and then return to the US on TN permit. He has been in Canada for 8 yrs, and does not want to consider to move to the US any more.
Canada has a bit slower life, but is better socially and people are friendlier. It has less professional opportunities, lower pay and more tax. Yet, overall I think Canada is a better place to live. Why am I in the US? Purely for professional reasons. I visit Canada quite frequently, which I consider as my home.

Subject: Injustice :mad: for people with priority dates in '02, '03, '04 etc. who are still waiting for their labor certs to be processed using the traditional process - we want to file a case against DOL's lethargy - Let us join together and file a case against DOL and bring justice to this unjustified system.
The manner in which the backlog reduction center have been processing the
labor certs seems to be very unfair for people like me and others who have been affected. I know of cases with priority dates as late as 2005 that have gone through the traditional process and have been approved already. And there are cases like mine and others with much earlier priority dates that haven't been done. This is very unfair and unjustified. It is like we have been standing in the queue for several hours and a person who came much later than me just sneaked into the queue and got his service done while I am still waiting for my turn. Also the fact that now the UCIS has made the filing of I-485 current adds more insult to the injury that I and others in my position have endured.
The fact that the I-485 was made current and then withdrawn was made a big deal and people wanted to file cases, whereas the plight of people like me who are still waiting for the labor cert to be cleared has been totally
ignored, inspite of the fact that people who applied for labor much later
have been approved through the traditional process.
We want to file a case ASAP with the DOL or other relevant
authority regarding this issue and the unfair way of the process that we
have been subjected to. So can all those folks who have been affected by this join and voice your support? We shoud put up this fight because this is in no way justified. Why would it be?
The next steps should be:
- Get all of the support we need from all affected folks ASAP
- Get in touch with a lawyer who can help us to prepare the case
- File the case in a court against DOL
- Make sure we get justice

Yes I posted scraps on individual members' scrapbooks, not just community posts.
I suggest if you are on orkut, scrap any and every one in DC communities, if a lot of people ask them to come, they will know how important it is!!

As I was explained SSA do not classify Economic Stimumus Package as a Federal Benefit. For them Federal benefit is a recurring payment of certain amount and the Stimulus package is just one off.
Also, we should try and get our message across to IRS about dependents who can not have SSN due to the nature of visas issued (H4). IRS should update their system so that if first person filing the return has valid SSN, payment should be calculated as it would be if everyone has SSN. This would be lot more easy then issuing SSN and then filing 2008 returns with those SSNs.
Any thoughts/ feedback?

Guess many have chosen EB2 as they were eligible by that time .I dont understand why EB3 I is being projected so negatively.
Many have already transferred EB3 to EB2.
2001/2002 may be there are still duplicate open applications which USCIS have to sort out .
Lets hope for the best...But seeing Bharat Premi responses...builds hope.
