I have been to the indian consulate couple of times and what I have seen so far is that people staying in the US take the consulate officers for granted.
People take the token and start filling up the form in the consulate itself, they will be at the window and will be pasting photograph or filling up the form itself on the counter.
I think the consulate officer should ask people that will you behave the same way at an US consulate??
People become impatient just waiting for 10 minutes as if they entire indian consulate has been waiting for them to show up at the office.
The way we Indians behave boarding a flight in US, the same does not happen in India. The way we behave with the consulate officers at Indian consulate does not happen at the US consulate. Why do not the same people trying filling up the form at the US consulate or try pasting photograph and even run to grab the original when they are at an US consulate.
We want the same level of professional at the Indian consulate then we need to show the same level of professional at Indian consulate that we show at US consulates.

Interesting observations Deepak. Issues are not very simple and are very deeply rooted to even think about changing them. To begin with there are tooooooooo many mouths to feed and people still dont realize the importance of population control:(:( Whe demand heavily outweighs available resourses then competition increases (basic to Darwinism). Primal instincts of survival come into play and behavioural modifications visible in the western nation are easily wiped off. Generally people have a desire that things be in an order but unfortunately due to the population stress prevailing in India, "disorder, corruption, favoritism" are the "order".
Will your generation be able to see this change? Possibly not?
Introduce the same stressors in the west and you will notice the same habbits surface here too. Natures way of dealing I guess??
One thing is for sure; If you practice non-violence in thought and action then chances are that your surroundings will ultimately reflect that same back to you. The way you react is most important than what the surroundings actually are. :D:D:D:D:D
Just read through a few posts in this thread and you will see "different" types of reactions and the ensuing emotions....That is all going no where. It all goes back into the global cloud of emotions and thoughts that you and me subscribe to, to live through this life.....Putting good out and taking good in is the only thing we can do...

URGENT HELP
Its a simple case. Its no company A, B, C and D and all applied for H1's or some vendors troubling me...so pls help.
I read all the posts on this thread but I dont think I got an answer I want. Here is my dilemma -
Scenario: I currently work for Company A. I interviewed with Company B and they are ready to file for my H1b transfer but they need me to join within the next 3 weeks. Today is Feb 6th 2008.
Question1) Is there anything like a H1Btransfer or is it a brand new application??
Question2) Does this H1B transfer go through the 65,000 quota system?? Is there a chance my H1B transfer can be rejected because I did not make it in the 65,000?
Question3) When can I start working for Company B?
Question4) Company B said that I should only inform Company A after I get a receipt from USCIS about my H1B transfer. If Company A matches up the salary what Company B is offering me after I inform them and I still havent started working with Company B, can I stay with Company A? If yes, What about the H1B transfer application by Company B?

Republicans are generally more amenable to legal immigration fixes than Dems. While not all of the Dems are bad, most of them dont care about legal immigration -- they just want the illegals. If it were not for these Dems, 5882 would have sailed through by now
I am sure NoBama will say CIR. illegals first. etc. etc.
I am not sure how much the next president will affect the passage of the bill through the two houses since they were majority democrat and will continue to be majority democrat. Senate is projected to continue to be majority democrat even after the upcoming election (when 1/3th of the Senate seats are up for election). A Republican president might not veto such a bill. Not sure if Obama would veto a bill which has passed through a democratic majority vote. Just a thought........I could be wrong.

I am self filing I-131. I have couple of questions. Can anyone help me with these?
I am a July 2007 filer. I paid the old I485 fee (and biometric fee). I understand now I have to pay $305. But the instructions also say I need to pay $80 biometric fee. My fingerprints were done in 2007. I do not see anywhere in I-131 instructions that says 'Biometric fee is not required if fingerprints were done already or may be I overlooked it', but it seems someone posted in this thread, bio metric fee is not required.
My question is do I pay $80 now or not?
My second question is on "Class of Admission".
My last entry to US was on H1-B. Now I am working on EAD. What would I write in this box? H1-B or EAD or "Pending 485" or "Advance Parole". I was thinking it is H1-B, but wanted to make sure as I do not want to take any chances...?

Well majority of the people on this thread and forum is finding this as just cause, I am totally for it.
However no one is sure if this logic will hold water. Well none of us are lawyers, thus our arguments for or against doesn't hold. Someone said at the start of this thread that let's consult some big lawyers.
People are ready to contribute (including me) and I personally think that IV Core will be the best forum to take this up with lawyers. They already have an existing network, have folks that have participated in efforts related to legal immigration,

AILA now feels defeated because they could not show themselves as the protector of this community. If you see the lawsuit text by AILF, it clearly asks for money for lawyer fees, but does not asks for moeny for Medical exam and mental agony. So if you are going to trust your lawyers to help you, then good luck.

Why file a lawsuit seeking injunctive relief to allow plaintiffs to file and at the same time demand reimbursement of medical fees and compensation for mental agony (I doubt if there were any plaintiffs put on anti-depressants or therapy in those two weeks as a result of the decision). You can't have your cake and eat it, you either win the case to enable filing, or you sue for damages incurred as a result of the decision but then you have to forget about contesting the ability to file, I'm sure any sane individual will be glad to choose the former and in this case thats what the lawsuit reflects. If you have ever read any class action lawsuit, the lawyers always ask for costs of the suit, this is normal even in non class action lawsuits, the loosing party pays the prevailing party's costs!
In the prior lawsuit that was lost, it is clear that Rajiv said recently that such cases against the executive branch of government need to filed in other federal court circuits other than the DC one where it is likely they will not be inclined to frown when deciding against the executive. we are a grassroots organization
i think we take pride in the fact that the flower campaign originated at the grassroots. let's not forget though
1. without "iv" as a whole which is all of us, the flower campaign would not be a success
2. flowers alone did not reverse the desicion. a lot more happened including lobbying. don't forget what congresswoman lofgren did...
moral of the story: if we all work together we can succeed, just talk is useless. and a many pronged effort is needed. this is not going to be easy...

rather my post was meant to challenge your interpretation in the common interest. however after seeing your response i did look up the bill text and agree that the provisions on the Section 405 (e) seem to apply to retroactively to all who would have been in such status if the section was in force when the graduated.
My earlier comments were based on Bill Frist's own summary of his bill and not any third party's. however the summary does not mention anything about the retroactive nature of adjustment of status under f-4

Once you get a receipt for your H1 transfer application you can start working for the new employer. From that point onwards your H1 application is linked to your new employer and no longer dependent on your old employer. I would suggest follow up with USCIS regarding your case.

There are many not so preferred areas in Canada, where there is always a demand. Most people prefer large cities such as Toronto, Calgary, Edmonton, Vancouver, etc. These are mostly saturated, but with persistence you should find something even there. If you don't care where you live, you should definitely find a lot of openings in the area you mentioned.

How about meeting all our local congressmen and lawmakers in the next few weeks??
Since one of our key issues is educating people about our plight, it would be good to meet some of our local senators/representatives and explain our side to them.
Many of them are equally clueless about the difference between green card backlogs and H1 B visa limits (my local rep for example), legal and illegal immigration etc.
So instead of holding a rally so close to this one, why not have a few more lobby days or meetings with our reps??
Incidentally I like the idea of sending doughnuts/pizzas to the media people specially CNN...:) for obscuring our rally and misrepresenting it as "Amnesty demands"...:rolleyes:
