    Commercial airlines fly between 25,000 ft and 40,000 ft. Airlines generally take risks for profits. I know it. Some airlines like United are ultra sensitive to turbulence. Some fly right through turbulence. And sometimes I feel some pilots are plain incompetent, they have no control over aircraft during the storm.

    I have personally taken 500+ flights, almost 2 every week. And I can say, I get really nervous when turbulence or strong clouds are present. You are one second away from the big one. Always always wear seat belt during turbulence, if it gets severe, you will hit the head on the ceiling. The turbulence during take off and landing is usually more risky as aircraft is closer to ground and can not afford to lose altitude. If it is at a higher altitude, aircraft can lose some altitude, due to "air pockets" and still be ok.

    yes, i do understand that. I still donot understand why fly into a "thunderstorm"!

    Well...I am one of us stuck in EB3. I do qualify for EB2 but my employer choose to file it under EB3. I recently invoked AC21 and moved over to a new employer on my EAD. Is there a way I can ask my new employer if they can file new I140 under EB2 and change my category to EB2?

    I am also like you. As I have been searching this forum, I understand that you can ask your new employer to process a new EB-2 PERM, once it is approved, the new employer can submit for I-140 with interfiling of old PD of EB-3.

    We have seen in the past years EB3 ROW got huge visa bonanza at the cost of EB2 I & C. And now apparently EB2 I & C is getting rightly deserved visa bonanza.
    How about asking DOS to give similar visa numbers to EB3 I & C as a one time exception. I know people will say it is against law, but in my opinion law is fuzzy enough for this to happen.

    DOS can give explanations like "Visa numbers will be given to oldest PDs or some thing". Per my calculation EB3 I needs 68K visas to move past 2003.

    We (IV) may have to make representation to Secretary of State and try and convince her.

    I dont think so as I am from BEC with PD of Jul, 04, EB2 I and still waiting.
    Are we assuming that all the BEC (Backlog Elimination Center) EB2's have already gotten their GCs..?

    I would not agree with your interpretation. You are insinuating that a majority of the EB based green cards sponsored by employers are similar to family sponsored green card and also that people are favoured for their nationality....

    The 7% law doesn't take into account the current diversity figure of USA.
    I don't belive Indians and their descendants form a significant majority to affect diversity ( compared to the ones from some of the EU countries and their descendants ) figure.

    For eg. The number of Italian americans is around 16 million , where as the Asian Indian Americans are around 2.5 million.

    Yes, that is an issue. You will need to get an affidavit. The affidavit can be faxed or scan+emailed over to you.

    Gurus,

    I would like to discuss about changing from EB3 India category to EB2 India category. Currently the PD for EB3 India is somewhere in October 2001. We know people with PD November 2001 to current waiting for GC to get approved. Now the questions I have and topic I would like to discuss are,

    1. Do you guys think that people with PD November 2001 to November 2002 should change the category from EB3 to EB2? (If they are eligible and if they want)
    If you have any reason that these people should stay where they are and wait, please share your opinion.

    2. Do you think that that people with PD November 2002 to November 2003 should change the category from EB3 to EB2?

    3. What about people with PD after January 2004?

    4. Where do we draw the line? We need to help our community to make the best decision on whether to move it EB2 category or stay where they are.

    Agreed. I think there are people like myself whose PD is in 2002 and are eligibile to move to EB2 after finishing advanced degrees and adding another 5 years of experience during the process.

    It�s good that at least some of us are getting VISAs, instead of VISAs being lost.
    However if this continues we could see a big movement to switch over to EB2 with or without porting PDs. This may in turn help EB3 :)
    We need to make this a sticky thread, so that we can brainstorm and put best ways to switch from EB3 to EB2 w/keeping older PDs.

    The ability to transfer priority dates from an earlier, approved, I-140 to a later-filed I-140 could provide an alternative for job mobility, both within the current employer's organization or with a new employer. This would be helpful for those who want to make a change but are not eligible to file the I-485 application because of retrogression. It also could help people who are eligible to change from an EB3 classification to EB2. One would be eligible to request a transfer of the priority date from the earlier-filed EB3 petition to a new EB2 petition once the I-140 is approved. The new EB2 petition would need to be based upon a new LC for a position requiring the EB2 level of education and/or experience. (Over time, many people with EB3 cases have become eligible for EB2 cases due to increased experience and/or education, and promotions.)

    This strategy potentially could shave off a few years in the queue for available immigrant visa numbers. This may be particularly appealing to those who had EB3 labor certifications filed on their behalf long ago and have had their cases pending while they have gained advanced degrees, acquired several more years of experience, and/or are offered jobs at higher levels. Keep in mind, though, that this involves filing a whole new LC under the PERM system for a new job opportunity and that the employer must actually require the additional degree and/or experience for all persons holding that job classification in order for the new case to be filed as EB2.

    I can tell your case. If you apply now by EB you will get gc within 3 to 7 years time. If you apply by point system after 5 years of USA experience and you will have employer sponsor you will have 16 points more than those who are coming fresh to USA. So both point system and EB system you will get at the same time period. Process delay will be minimal as no labor or I140. But initial period there will be delays as it is entirely new and untested. We cannot compare EB and point system now. Only point system comes we will know the problems

    First of all, it is not "my" case. I have been waiting in line for my green card for the past 5 years with my labor stuck in BEC. So, under the current CIR draft, I will be one of the biggest losers as I have not filed for my I-140 and so, my whole application will go down the drain after 5 years of time, money, energy and emotional stress.

    How do you come with a math where I will be able to get a GC immediately after 5 years if I apply under the points system? Did you even read the draft bill? How will I or anybody else for that matter, manage for next 5 years without a GC when they are squeezing out the H1B (fee increase, removal of dual intent etc)?? Next would be the per country hard quota that will put us in an eternally long line.

    I would definitely compare the current mess of a EB based system with the untested point system and take the current system any time as it is a known devil. The merit system is no angel either. Atleast in the current system, if I wait long enough, I know that my turn will come.

    How do you know that process delay would be minimal? USCIS's current delay is not because of process, it is because of the sheer volume of applications and lack of man power. The PERM system takes one month. If you pay premium processing, it takes them 15 days to clear your I-140. So, where is the delay in process? All the delay is from the past backlogs which this bill fails to address and at the I-485 stage where they have to do background checks. That will exist in the points system as well. After you discover the problems in the point system, what will you do then? Ask for another CIR bill??

    You don't have to tell what "my" case is. I live my case...

    Dear Sir,
    Not convincing. 2006 was when Retrogression started. And it was declared HUGE only in 2007,8,9,10. Just because some Tom or D has forcasted that therez gonna be huge retrogression, we dont base our GC plans on that. Correct..

    If everyone were to go with your logic, then I guess EB2 qualified guys must wait for .. well how many years, u tell us.. to apply in .. EB1 ".. And what shoudl EB3 guys do..

    The point is, lets focus our energies on the main problem which all of us face, and not show any disgust on any one category. I know how it feels if someone is coming in front of me in my line.. But how can we stop them.
    Lets bring attention to releasing those wasted visas, quota problems etc..
    If equal spillover happens from EB1 to rest of categories, EB2 will affected immediatley.

    Its personal choice if and when they want to start the GC process if there is an opporunity. I also didnt start my GC even though my first employer wanted to start the GC for me in 2005 and I refused for whatever stupid reasons...which I am regreting now

    Just like IRS will be mailing checks to provide stimulus to the economy, IV bills need the stimulus of your checks to move forward.Now that Stimulus checks are in the mail, it's time for the community to loosen the purse strings and contribute to something that will benefit you immensely.

    Let's not let this historic opportunity go waste over a sum of $50 or $100, something many of us spent just to get to the nearest available USCIS recognized doctor for our AOS medical tests. If these bills pass the savings are much greater - EAD/AP/DL renewal fees, FP fees, AC21 fees (whenever you change the job) etc. Now that the new Medical form has been posted - with additional TB testing - old tests may be considered invalid after a period of time ( I'm not saying they'll be, but knowing USCIS anything's possible). Not to mention job opportunities lost due to a missing plastic card - every one of us, EAD users, has at least one experience, where we couldn't apply or were denied opportunities for not having GC.

    Considering the cost vs. benefits ratio, and the low risks unvolved (you aren't investing whole of your 401(k) here), let's not act 'pennywise and pound foolish'. Lets not fall victim to self-defeatist pessimism and thriftiness. If ,God forbid, the bills don't pass you are losing just 50 bucks, 100 bucks... something you'd have lost when the mail-in rebate check got lost in mail (or not got posted at all!). It's not like any of us will be losing our retirement savings or all our stocks. I'm sure no one will foreclose their homes because of it :-)

    We raised more than 30K when there was no bill (Omnibus), now that there is a bill under discussion, I can't see any reason why we are taking so long to cross a modest 10K?!
