The extremely contrasty background doesn't help, and the blown highlights on the dog's nose are also distracting. I'm not sure how much it would help, but you might try using fill flash (that still won't solve the background issue). Shooting on a day that's not overcast might help bring the sky into range.

I am an analyst under H1B and I am involved in a sales process by developing a prototype for a client. My company wants me to give a percentage of total deal as commission. It will show in the pay stub as commission. Is it legal to get commission under H1B (please remember I am a programmer analyst) ?
As long as the payment comes from/through the company that is sponsoring your H1B, you're fine.

I have been in the US for a couple of years working on an E-1 Visa. I am now filing my I-765 because my Visa is tied to me working for a particular company and is not transferable. I have a social security card.
I am now not sure if I should fill this out as if I am applying for a or b:
A) Permission to accept employment
B) Replacement (of lost employment authorization document)
C) Renewal of my permission to accept employment (attach previous employment authorization document). Form I-76
If it is C, should I attach a copy of my E-1 Visa and my Social Security card or something else?
Also, for question 11 (Have you ever before applied for employment authorization from USCIS)? I don't think I have. I think my E-1 Visa came with this right and that I only dealt with the social security office.
Please help if you know the answer

I was wondering if this recession could turn out to be a silver lining for those of EB2-I,C who manage to survive it. Come to think of it, with all these job losses theres bound to be a downturn in hiring - resulting in lesser number of EB1 and EB2 ROW applications. This means more could overflow to EB2 I and eventually EB3 (I,C and ROW) survivors will benefit to.
Although we also need to remember that the H1B quota will still get filled up on Apr 1 - recession or not. So don't really know how this would turn out.
What are your opinions folks?

It shouldn't have any negative effect. It would be better to withdraw the application, rather than just abandon it.

I have noticed that they have been given instructions not to give any information now due to the volume of calls HOWEVER if you keep trying you might get one person who is kind enough to answer your questions..
I tried 3 times (called with few days in between) and two time I faced pretty short replies with no help. But third time I got a very nice person who gave me more info. Among the few things I learnt were that they are still doing cases as of Aug 2006 and few random cases are being worked on dates after that. Details about I-140 will not be told unless you are the employer or the attorney. But you can ask about the status of your name check.

My RIR labor was filed and have a PD of Nov 2004. It was stuck in BEC and my company decided to file my PERM in 2006. Now my I-140 based on PERM application was just filed, when my RIR based labor was approved. My 6 yrs of H1 exp Feb next year. I can't file my RIR based I-140 as my PERM based I-140 is already filed. So I'm planning to premium process my perm based I-140. Also my comany will file I-140 based on my RIR application for better PD . My questions are:
1) If I get 3 year extension based on PERM based I-140, will there be some problem in future if I change my company and try to use my RIR based PD (after I140 approval)
2) or should I premium process my RIR bases I-140 also (after getting my current PERM I140 approved), so that I can file my H ext based on RIR applications to avoid any problems in future for PD retension

H1b extension was denied with reason of "Employer-employee relationship". RFE was responded to (with requested pay stubs and W-2) and was still denied. Now, attorney from company is filing for MTR. How long does MTR processing take as the case was already existing? Does that matter or it doesn't? How long did it take to get a decision from CIS?
Is it possible to file MTR from company A (employer) and to file a new petition from company B (middle vendor who has direct contract with client)? Can the MTR be withdrawn in favor of a new petition?
Did anyone go for MTR and how many days did it take to get the decision?

But if you can't control the vitriol coming from the Tea Party wing and actually work with Dems on immigration reform, you're not going to reverse the damage. In short, conservative Hispanics still perceive the GOP as anti-them. And PR campaigns aren't going to fix that problem. But promoting pro-immigration candidates, as some groups mentioned in the article are doing, is a hopeful sign.

Hi, I have approved H1b through company "NewCompany" but my GC sponsoring company "GCcompany" is planning to cancel my APPROVED 140. Again, I know USCIS will do inted to deny and Yes, I have filed for 485 + it's been 180+ days but I guess the most important question of all is:-
"Will this affect my H1B status?' Since the approval for new 3 year (extension) was based on my 140 and now this thing is under jeopardy. If I use EAD, my wife will no longer be H4 and thats a different problem- Gosh when is thind going to end?"

I came to US on L1 in 2005 thru COMPANY-A and then applied for H1B thru COMPANY-B in 2006 and got approval under 2007 CAP. But I didn't start working for COMPANY-B(H1B) and went to India after H1B approval but came to US on L1B again to continue my work with COMPANY-A(Did a leapfrog).
In 2009 I transferred my H1B from COMPANY-B to COMPANY-C and got the petition approval. So I have a valid H1B petition with COMPANY-C.
In the same year my COMPANY-A(L1B holder) applied for COS to H1B under new 2010 CAP and got approval. So my status has been changed from L1 to H1B with COMPANY-A.
Now I have 2 approved valid petitions, one with COMPANY-A and the other with COMPANY-C, my question is if I get an offer from COMPANY-C can I start working with them with out any H1 transfer application ?
or can I transfer my H1B from COMPANY-C to another COMPANY-D ?

has there ever been any regulation issued by the USCIS for the AC21 law? i know about the yates memo in 2005. however, even that memo says that there will be a regulation coming in... so was that ever published? i just want to find out once and FOR ALL whether uscis will allow me to do self-employment in a same or similar job and how prepared should i be for zealous immigration officers sending me way-too-detailed RFEs for stuff related to self employment... i contacted a few lawyers, the only one who was encouraging enough for my taste said that she/he will charge me my arm, leg and possibly an eye or ear... so whats out there already?

If you can get to the soft copy of the checks usually provided by most of the banks, you can find the receipt number on the rear/back side of the check.
