Those of you who have been reading this blog awhile will recall the many posts I've written regarding major problems in the system of detention for immigrants facing potential deportation. Nina Bernstein of the New York Times reports this morning that the White House will enact a series of reforms designed to curb abuses. Folks,

I have a question about a new H1-B application while I-485 is pending. If I-485 is pending and the person is currently working on EAD with expired H1-B, is there a requirement that the person has to leave the country to apply for a new H1-B based on pending I-485? If yes, will it affect the green card process negatively?

My attorney says that as there was a gap in H1 status, one has to leave the country for a new H1 application, even though it is with the same employer.

Do nothing. It is an oversight and not worth worrying about. You can send them a letter and they will put it in the file but it isn't worth much.

I am a strong supporter of Comprehensive Immigraton Reform (CIR). I have been on both sides of the fence. I had filled my & my wife's 485 on July 16th 2007. However I noticed that the check that I had sent for my 485 had a minor overwriting in the amount field. I had filed for my wife's H-4 extension last month with a similar issue in the check and the USCIS has sent the H-4 application back. Obviously, I do not want the 485 application to be rejected. So i need urgent help on this matter from you all immigration experts, please help me weigh my options:

1.) Can I refile 485 for me and my wife? Is it possible to have 2 485 applications for a person.
2.) If I refile, and then the USCIS accepts my first application, then will loose the fees for second application or will it be refunded?
3.) Do you think I will simply be asked for another check if I dont refile (which I really doubt.)

I know the mistake might sound stupid but Please guide me in this dilemma. Any help will be greatly appreciated.

Hello Attorney,

I filed AP for me and my Dependent , Unfortunately USCIS just picked the application on the top of packet ( My Application ) and i got the receipt No , I dont know what happened to my Spouces Application her check is not cashed and no receipt no , I suppose her applicaiton is was just placed with my applicaiton and was considered as just one application .

Now what are my options , can i go ahead and file one more application , i know its literally impossible for me to call uscis and Track my wife's application , can i go and file a new application for my Spouse . Please advice.

I am on H1B visa, and now I am going to fly back to my home country. Unfortunately, I can't find the original left lower portion of my I797, which is "for personal record". I still have the orignial upper portion, I94, and copies of the whole I797 form.

Will I have trouble getting my visa stamp and reenterring this country? What should I do now?

Does anyone know how slow/fast/better is the Counsular Processing back in India if you ever become eligible to do that?

Don't go for it. It may be fast but you are working with too many variables that may go wrong. I went back home last year for CP and suddenly I became a victim of retrogression. I missed my cutoff date by two days. Then I had to wait for about 3 months to get my H1 stamp. I was lucky that I didn't lose my job here.

USCIS kept on updating the total number of cases received for H-1B for FY 2009-10. However, the recent USCIS H-1B (http://www.h1b.biz/lawyer-attorney-1137085.html) cap count indicates decline in number of cases than what had been previously reported. The updated count reports the receipt of 44,400 �Regular� cap cases, by June 12, 2009 which is lesser than the prior count of 47,700, given as of May 22, 2009. There is no explanation too from USCIS for this decline in trend. Thus, this reduced number may reflect either withdrawals by employers, denials by the USCIS, duplicate filings, or an error in the prior cap counts.

As of this writing, both the Advanced Degree and Regular caps remain open. We will continue to provide updated H-1B cap count information.
