You can only stay in the US if you can change to another lawful status. As a UK citizen, the only work-authorized status that might be available, though difficult, is O-1 for extraordinary ability aliens. If the company won't start the permanent residence process for you, unfortunately you have very limited options.

Hello,
My I-485 was filed this July. My wife and I got FP notices for Nov 20. But my wife is currently in India and I will be in India too on Nov 20. So we will have to reschedule at least for my wife.
My question is, has anyone who filed their I-485 after July 2 rescheduled their FP appt and got a new appt date? I'm in the San Jose area.

This is very confusing. I already sent my I-485 along with a new filing fee of $1010 in total $930 for the application and $80 biometric fee last August 3rd. USCIS already received my application my question is are they going to reject my I-485 b/c they just revised that we have to pay the old filing fee for July Bulletin? I used The current I-485 form version dated �7/30/07 Y�.
I'm so confused! Due to this, I'm just gonna send another application b/c the chances of them rejecting/returning it back to me is High. If they don't return it back this week then I won't be able to file my I-485 after August 17th. Is ok to send another application? Can I just attach an explanation? I would rather take this chance than not being able to file it again after Aug 17.
Can someone please tell me the old filing fee including the biometric fee??

I am a F1 PhD student The company we've been cooperating with gave me an internship offer for this summer working as an independent contractor under CPT for three months.
The univeristy international offer and the career office are both OK with this but I saw some opposite opinion online. Could someone give me a clear answer: is this legal F1 student under CPT working as independent contractor?

I did send my wife's and my daughter's RFE in one package. But have separate cover lettter and folder. One packet is enough, clearly distiguish between two set of papers.
My wife and I got RFE on medical. Now I am sending response to RFE. Do I need to send the RFE response individually by FEDEX or Can I send both of us responses in one FEDEX package? Please advise. Thanks.

I am on a H1B with company A. I've been offered a job with company B which is currently processing my H1 transfer paperwork. I had accepted the offer letter from company B and had submitted all my papers for H1B transfer.
The starting date in the company B is 20th Nov as per offer letter. Now I had decided to stay back with the company A (by 18th Nov) before joining the company B. Is there any issue by doing so?

Thanks. But I heard if they find something critically wrong on 485 form, they may reject it and return it in as long as 3 month! Why can't they just make sure the forms are OK and then start the name check?

Hi,
My parents are currently in the U.S. on their visitor Visa (B2) which has 10 yr validity running till 2014. Their visa was originally sponsored by my sister and brother in law. Now we would like to extend my parents current stay beyond the six months I94 and we want to file for an extension. However, the financial position of my sister has changed as she is out of a job now. Is it possible that we can show me (son) as a sponsor, showing my financial statements/pay stubs as proof of financial support? This might mean I am taking over sponsorship now though their 10 year visa was sponsored by my sister. Would this be a problem leading to rejection of extension, or worse, affecting the validity 10 year visa itself?
Please let me know. Appreciate your time. Thank you.

Such an action would be illegal, but CIS has already stopped accepting I- 485 applications for another category known as "Other Workers," despite June Visa Bulletin showing that category is current. My advice to all of you is keep filing all through the month of July. For all we know, they may never issue such an illegal policy or they might lose a lawsuit filed against them. So keep filing.
