I have an old priority date with previous employer (jan 2006), however my I140 with the new employer has date of May 2007. I can also apply for 485 under NIW. My question is if I apply for 485 by both pathways(two different applications), can I recapture the same PD of the old employer TWICE?

Hi,
I am currently on STEM OPT and have lost my job. I have an offer from Company A but they are not willing to enroll into the eVerify system. To bypass this, they suggested that I take up employment with a consulting firm B (who is enrolled in eVerify) and then work on company A's project as a contractor through firm B. Would this be legally OK? I heard that even though I would be on company B's payroll, company A should still be registered with eVerify.
Can someone please advice on what is the legal requirement??

My EB3 RIR is filed on Feb 2005. Waiting for LC to clear. Also H1B expires on Jun 2007. Waiting for H1B extension for another 1 year.
I would like to change my job once I get my H1B extension.
1) Can I change my Job during my one year H1B extension when my LC is not cleared?
2) Can I use my current PD (Feb 2005) when my new Company process LC again through EB2 PERM?
3) From the new company, once I get LC through EB2 PERM, can I apply H1B extension for 3 years?
Please advice. Waiting for you reply.

If we're thinking of the same thing, the cover letter basically is a simple letter that explains what is in the package and what is the purpose of the package/envelope/application. It enumerates all the documents enclosed, almost like a checklist. You don't have to enclose it but it'd be good to do so not just for you but also for the person opening your package so they know if you enclosed something that they're looking for. It kind of keeps the whole thing organized.

Yes, You can file for H1 extension and they will give you extension for the remaining period of 6 years.
FYI, total days of 6 years are counted based on your presence in US. so, even your out of US periods also can be recaptured.

It should be okay. I sent to my attorney as well as my HR. I do not see any issues as long as it is just GC copy.

yes we came back on new year and flight was very good, nice food and staff was really cooperative. At POE it took us 2 min to get out of immigration and custom check. Officers were polite and nice. We both used AP and no questions were asked. I would highly recommond this flight.

This was inevitable. As Chris Hayes of The Nation told Keith Olbermann this evening, a boycott could "recalculate the incentives" for the citizens of Arizona and the politicians in the state. Once Super Bowls and major conventions start to go elsewhere (as was the case two decades ago when a similar boycott was successfully used to protest the state's failure to recognize the Martin Luther King holiday), the cavalier anti-immigrant positions will become a lot more expensive. LCAs for consultatnts definitely are challenging, since they move around so much. In your case, a new LCA is not required because the new position is in the same Metropolitan Statistical Area (basically the same town) as the old location.
In general, CIS and DOL distinguish between employees who are roving as part of their job, and those who are sent to a new location for a short term. The distinction is too complicated to go into here, but hopefully your company's attorney is well aware of it.
