Hi,

Need some help here for my friend.

He is an employee of company A and his first 3 yrs H1 is ended say Sep
25, 2009. But he was already got a new H1 approved 1 month back from
company B and that company had assured him to take him on board from
Sep 26, 2009. So he and his wife had both approved H1/H4 from Company
B. Now last minute the company B backed off from their agreement.

So he went back to his company A and asked for H1 extension on Sept
24, 2009 and for which they filed papers. But they didn't file papers
for his wife's H4. Can she be on company B's approved H4? if not how
many days she has to file for H4 linked to company A.

don't graduate till the summer semester
stay and take a course
or arrange to have CPT

or just go home and enjoy 3 mnths, your H1B will be stamped in the proccess
you application must be amended not to say adustment of status (in the US), the approval can be sent to your local consulate

or go on an O-1 if you can qualify....

So I'm in need of an answer for my parents.

They have their green card and have been out of the United States for a little less than 6 months now visiting their homeland. They will be returning in a week but due to a medical circumstance that has happened with my mother overseas, she would need to go back to their homeland so she can acquire her medications and chemotherapy there. What is the minimum amount of time they would have to stay here in the United States until they can go back to their homeland?

I know you can stay out of U.S. for no more than 6 months or their green cards make be revoked, I understand that part but I'm curious if there is a minimum amount of time they'd have to stay here in the Unites States before they can go back overseas so it doesn't look bad when they go through immigration.

H1b from non-cap to cap cannot be transfered. In order for you to work in private companies, you need to get new H1b by filing in on april 1 st 2009 which will ahve start date of oct 2009. Untill then you are stuck ..!!!

However you can transfer your present H1b to another non-profit h1b. I know the rules sucks..I ahve been in your place and got H1b this time. Can't wait to to get freedom on oct 1st.

They might increase the no. of H1Bs but might not do any refinement in the immigration process I guess.:o
So can't say how that would be advantageous but nevertheless the economy is boomin and there are lots of jobz.:)

As I read the memo, it is OK for two employer to file H1B for a employee.

We discuss in this forum and IV discourages this.
